This page sets out the full project conditions that apply to all website and webshop development by Kaige Productions, including WordPress, WooCommerce and custom development projects. These conditions supplement our Terms and Conditions and apply to every quotation and agreement, unless explicitly agreed otherwise in writing.
With these frameworks in place, we ensure a professional and transparent collaboration, with clear expectations regarding scope, responsibility and delivery. Clear arrangements upfront allow us to focus on what really matters: building a strong, durable and technically solid online presence.
Every quotation for website or webshop development standardly includes the following:
The following cost items are not included in a standard quotation, unless explicitly stated:
The amounts stated in a quotation are based on the activities described and the estimated number of hours required. Activities falling outside the described scope are considered additional work. Additional work is reported in advance, including a cost indication, and invoiced on a time-and-materials basis at the hourly rate applicable at that time, in accordance with article 10.3 of our Terms and Conditions.
The content, scope and any deviations relative to the original agreement or quotation shall be considered agreed only when confirmed in writing by Kaige Productions.
Delivery shall be understood as: the moment at which we make the relevant phase — design or content and technical functionality — available to the client for review in writing by email, or accessible via a staging environment or comparable preview environment.
From the moment of this written notification, the period for revisions and acceptance commences.
Texts and content must be supplied by the client in full and in final form, prior to the start of the relevant project phase. Incomplete or late delivery of content may result in delays and/or additional work.
The client is advised to provide all required content (texts, images, product information, legal documents and privacy texts) in a single bundled delivery, with a clear structure and mapping to the relevant pages.
The revision rounds are exclusively intended for minor adjustments and optimisations within the already delivered pages and the already delivered design. This includes, for example: textual refinements, typographical errors, minor substantive corrections, colour or font adjustments within the existing style, and minor visual adjustments.
Revisions must be submitted per phase within 14 days after delivery, in full and bundled. Individual revisions or those submitted after this period will no longer be processed within the agreed scope.
A revision round is expressly not intended for the resolution of technical defects (bugs). A bug shall be understood as a demonstrable defect in which previously delivered functionality does not perform as described in the quotation or the approved design. Bugs are resolved free of charge within the warranty period and do not count towards a revision round.
Change requests arising from new requirements, evolving insights, preferences or modifications relative to the originally approved design are not classified as bugs and fall under the revision rounds or, if these have already been used, are treated as additional work.
Following delivery, an acceptance phase of 14 days applies during which the client must fully verify the website or webshop, including forms, checkout, payments, email notifications and other functionalities. Following written approval, the project is considered delivered.
If no written revisions or objections are received within 14 days after delivery, the relevant phase shall be deemed tacitly accepted and formally delivered. Changes or revisions following (whether tacit or explicit) acceptance are treated as additional work, unless an appropriate maintenance contract has been concluded.
The client is fully responsible for the accuracy, completeness and lawful use of all supplied content, including texts, images, product information, prices, legal documents, terms and conditions and privacy texts.
We do not verify this content for copyright, legal validity or substantive correctness. Any claims or damages arising from supplied content fall entirely under the client's responsibility.
We deliver exclusively a technical foundation suitable for search engines. Active SEO, content optimisation, link building and structural growth in Google do not form part of a quotation unless explicitly agreed.
We provide no guarantees regarding rankings, visitor numbers, revenue, conversion or other commercial results. Following go-live, migration or rebuild, rankings may temporarily fluctuate; this falls within the normal operation of search engines.
For certain functionalities it may be necessary to use third-party plugins, licenses or services. These costs will be charged separately.
The functionality and continuity of third parties — such as payment providers, shipping services, Office 365, hosting providers or plugin developers — fall outside our liability. If a third-party service changes, lapses or is discontinued, this may affect the operation of the website or webshop. Any adjustments or replacements are treated as additional work.
We test in current modern browsers and devices. Full compatibility with all systems, older browsers or exceptional configurations cannot be guaranteed and falls outside the scope.
By current modern browsers we mean the two most recent versions of Google Chrome, Mozilla Firefox, Safari and Microsoft Edge, as well as the default browsers of current iOS and Android versions.
WordPress and WooCommerce require structural updates and maintenance. If no maintenance package is purchased, responsibility for updates, security, backups and continuous functioning rests entirely with the client.
Issues caused by outdated plugins, overdue updates or external modifications fall outside our responsibility. We expressly advise our clients to take out a maintenance package in order to keep the website or webshop secure, stable and up to date.
Our liability is at all times limited in accordance with article 6 of our Terms and Conditions. As a rule, our liability is limited to the amount of the relevant assignment as invoiced.
We are not liable for indirect damages, consequential damages, loss of revenue, loss of data, reputational damage or damages due to downtime. The client remains at all times responsible for their own business operations, legal compliance and the correct deployment of the website or webshop.
Delivery dates are indicative and dependent on the timely supply of content, feedback and access to required systems (such as hosting accounts, DNS management, payment provider access and API credentials).
Delays in delivery may result in postponement of the planning without liability for damages or loss of revenue. In the event of prolonged inactivity (longer than 30 days following our last request for input), we reserve the right to temporarily pause the project and to charge any additional work for restarting the project.
Every quotation and all agreements you enter into with Kaige Productions are subject to the Terms and Conditions of Kaige Productions, available at www.kaige.nl/terms-and-conditions. Acceptance of a quotation takes place by means of one of the following actions: (1) signing the quotation document, (2) payment of (part of) the invoice amount, or (3) written confirmation by email. By accepting, you also agree to the Terms and Conditions and to the project conditions set out on this page.
For project-based work, you will receive an advance invoice of 50% of the quotation amount upon acceptance. The remaining 50% will be invoiced upon delivery, with a payment term of 14 days. For subscriptions, invoicing and payment take place in advance per agreed term (monthly, quarterly or annually).
Do you have questions about these conditions, or would you like to make different arrangements on specific points? Please contact us before signing the quotation at ln.egiak@ofni. Deviating arrangements will only become effective when confirmed in writing by Kaige Productions.
